Terms of Service

1. Agreement

These terms form an agreement between you and the operator of Vertex Chart ("we", "us"). By purchasing, requesting or using any of our indicators, you accept them. If you do not accept them, do not use the service.

2. What the service is — and what it is not

  1. We provide chart-analysis software: scripts that run inside TradingView or NinjaTrader and draw information on your chart.
  2. We are not an investment adviser, broker, portfolio manager or financial institution, and we are not registered as one in any country. Nothing we provide is investment advice, a recommendation, or a solicitation to buy or sell any instrument.
  3. Our indicators do not place orders and never access your broker or exchange account.
  4. Signals, colours and alerts are calculated from past price data. They do not predict future prices and do not guarantee any result.
  5. Every trading decision you make, and every outcome of it, is yours alone. Trading carries the risk of losing your capital, and leveraged products can lose more than the amount invested. Consider whether the service suits your objectives, experience and financial situation, and take independent professional advice if you need it.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You must not use the service where doing so would breach the laws of your country, and you are responsible for checking that.

4. Your licence

  1. On payment (or on approval of a free request) we grant access to the indicator on the TradingView username you give us.
  2. You receive a personal, non-exclusive, non-transferable licence to use the indicator for the period purchased. You do not acquire ownership of the software.
  3. Access through Whop is normally granted within 5 minutes. Other payment routes may take longer; where the delay is ours, we extend your access by the time lost.
  4. Give us an accurate email address and TradingView username. We are not responsible for failed or delayed access caused by incorrect details.

5. What you must not do

  1. Share, lend, resell, sublicense or transfer your access or account.
  2. Copy, modify, decompile or reverse engineer the scripts, or attempt to.
  3. Redistribute our screenshots, signals or documentation as part of your own course, product, signal group or newsletter.
  4. Use our name, logo or materials without permission.
  5. Use the service to provide investment advice or managed trading to others.
  6. Breach the terms of TradingView, NinjaTrader, Whop or any other platform involved.

If you breach this section we may suspend or terminate your access immediately and without refund, and recover any loss we suffer.

6. Third-party platforms

The service runs on platforms we do not control. Your use of TradingView, NinjaTrader and Whop is governed by their own terms, and their plans limit things such as how many indicators and alerts you can run. We are not responsible for their outages, data errors, delayed quotes, or missed or late alerts.

7. Changes and availability

  1. We may update, improve or change the indicators. We announce significant changes by email or on our channel.
  2. We may suspend or discontinue the service — for example if a platform changes its policy or shuts down, or for maintenance and events beyond our control.
  3. If we discontinue a paid service before your period ends, we refund the unused portion or extend access to an equivalent product.

8. No warranty

The service is provided "as is" and "as available". To the fullest extent permitted by law we make no warranty that it will be uninterrupted, error-free, accurate, or that it will produce any particular trading result.

9. Limitation of liability

  1. To the fullest extent permitted by law, we are not liable for trading losses, lost profits, lost opportunity, or any indirect or consequential loss arising from use of the service.
  2. Where we are held liable, our total liability is limited to the fees you paid us in the three months before the event giving rise to the claim.
  3. Nothing here excludes liability that cannot be excluded by law, including liability for fraud, or for death or personal injury caused by negligence. If your local consumer law gives you rights that cannot be waived, those rights still apply.

10. Termination

You may stop using the service at any time and cancel a subscription from your Whop account. We may terminate access for breach of these terms. On termination, your licence ends and access is removed.

11. Changes to these terms

We may amend these terms. We will post the updated version here and, where the change materially affects you, give notice by email at least 14 days before it takes effect. Continuing to use the service after that date means you accept the change.

12. Governing law and disputes

These terms are governed by the laws of the country in which the operator of Vertex Chart is established, without regard to conflict-of-law rules, and disputes are subject to the courts of that place. If you are a consumer, this does not remove the protection of mandatory consumer law in your own country of residence. Before starting any formal proceedings, please contact us — most issues are settled by email.

Privacy Policy

This policy explains what personal data we collect when you use Vertex Chart, why we collect it, and what rights you have. Contact for any privacy matter: vertexindicator@gmail.com

1. What we collect

DataWhy we need it
Email addressTo send access instructions, service notices and support replies
TradingView usernameTo grant the indicator to your account — the service cannot be delivered without it
Marketing consent (yes/no)To record whether you agreed to receive news about new indicators and updates
Payment recordsOrder, amount and date, so we can manage your access and handle refunds
Basic technical dataStandard server logs generated when you visit the site

We never receive or store your card details. Payments are processed by Whop, which collects payment information directly under its own privacy policy.

2. Why we may process it (legal bases)

3. Who we share it with

We do not sell personal data. We share only what is needed with the providers that run parts of the service:

ProviderPurposeData
WhopCheckout, subscriptions, access managementEmail, order records
Google (Forms)Free-indicator request form and its responsesEmail, TradingView username, consent
TradingViewGranting invite-only script accessTradingView username

We may also disclose data where the law requires it, or to establish or defend legal claims.

4. International transfers

These providers are based in the United States, so your data is processed outside your country, including outside the EEA and the UK. Where that happens we rely on the safeguards each provider offers, such as the EU Standard Contractual Clauses. If you would rather your data were not transferred this way, we cannot deliver the service.

5. How long we keep it

6. Your rights

Depending on where you live, you may ask us to:

Email us and we will respond within 30 days. If you are in the EEA or the UK you may also complain to your national data-protection authority. California residents may exercise equivalent rights under the CCPA; we do not sell or share personal information for cross-context behavioural advertising.

7. Children

The service is not for anyone under 18, and we do not knowingly collect their data. If you believe a minor has given us data, write to us and we will delete it.

8. Security

Access to personal data is limited to people who need it to run the service, and data is transmitted over encrypted connections. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

9. Cookies

This site does not use advertising or analytics cookies. Fonts are loaded from Google Fonts, which receives your IP address as part of that request.

10. Changes

If this policy changes we will post the new version on this page and, where the change is significant, tell you by email.

Refund Policy

1. Try before you pay

The paid set starts with a 14-day free trial on Whop, and Vertex UpDown and Vertex Line are free for two months on request. Please use them to check that the indicators suit you before you pay.

2. Before access is granted

If you have paid but we have not yet granted the indicator to your TradingView account, tell us and we will refund you in full.

3. After access is granted

Access is a digital product delivered immediately and it cannot be returned once granted, so payments are non-refundable after access has been added to your account, except in the cases in section 4.

If you are a consumer in the EU or the UK: you normally have 14 days to withdraw from a purchase of digital content. By asking us to grant access straight away you request immediate performance and acknowledge that you lose that right of withdrawal once access has been granted. If you would prefer to keep the withdrawal period, tell us when you order and we will wait before granting access.

4. When we do refund

5. Subscriptions

6. Lifetime licences

A lifetime licence is delivered in full when access is granted, so it is non-refundable from that point except in the cases in section 4. "Lifetime" means for as long as we maintain that indicator; if we discontinue it we will tell you and offer an equivalent product where possible.

7. Free indicators

Nothing is charged for the free indicators, so there is nothing to refund. To continue after the free period, buy a licence.

8. Trading losses are not a reason for a refund

We supply chart-analysis tools, not investment advice or performance. A loss on a trade you made while using our indicators is not grounds for a refund. Every trading decision and its outcome is yours.

9. How to ask

  1. Email vertexindicator@gmail.com with the payment date, the product and the reason.
  2. We reply within 3 business days.
  3. Approved refunds are returned to the original payment method, usually within 5 business days; your bank may take longer to show it.
  4. Access to the indicator ends when the refund is made.

Nothing in this policy limits any right you have under the consumer law of your own country that cannot be waived.
